By accessing or using Fireshield Wildfire Defense Systems LLC (Fireshield Wildfire Defense, or, Fireshield) website, mobile application, or wildfire defense system, you agree to be bound by these Terms of Use and Privacy Policy. If you do not agree, please discontinue use of our services. Continued use constitutes consent.
System Disclaimer
The FireShield Wildfire Defense System is designed to support wildfire mitigation, not to provide guaranteed protection. Performance varies based on environment, usage, and maintenance. It should not replace an emergency plan or insurance policy.
Not an Insurance or Emergency Service
FireShield is not an insurance policy or emergency response system. In any emergency, dial 911. The system is not a substitute for professional firefighting or evacuation protocols.
Installation and Maintenance
Only licensed professionals should install the system. Regular maintenance is required. FireShield is not liable for issues caused by improper installation or user negligence.
User Responsibilities
Users are responsible for:
- Proper installation and upkeep
- Understanding system limitations
- Following safety procedures and official emergency orders

THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. FIRESHIELD DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF HARMFUL COMPONENTS OR DEFECTS, OR COMPLETELY SECURE. YOU ASSUME THE ENTIRE RISK AS TO THE USE, RESULTS, AND PERFORMANCE OF THE SERVICES.
Indemnification
You agree to defend, indemnify, and hold harmless FireShield, its affiliates, officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of any provision of these Terms, or your infringement of any third party rights, including without limitation any intellectual property or privacy rights.
Force Majeure
FireShield shall not be held liable for any failure or delay in performance of its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor conditions, power failures, internet or telecommunications outages, or government restrictions.
Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Services. This includes, but is not limited to, all applicable data privacy and export control laws.
Changes to the Agreement
We may revise these Terms and the Privacy Policy from time to time. If we make material changes, we will notify you through the Services, via email, or by other means. Your continued use of the Services after such changes become effective will signify your acceptance of the revised terms.
Governing Law
These Terms and any dispute arising out of or related to them or the Services will be governed by the laws of the State of California, without regard to its conflict of laws rules. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Los Angeles County, California, and you hereby consent to personal jurisdiction and venue therein.
Assignment and Successors
You may not assign or transfer these Terms without the prior written consent of FireShield. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. FireShield may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
Data Security Measures
FireShield implements commercially reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. These include encryption, access controls, secure servers, and intrusion detection technologies. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee its absolute security.
User Account Responsibilities
If you create an account with FireShield, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. FireShield is not liable for any loss or damage resulting from your failure to comply with this obligation.
Third-Party Links and Embedded Content
Our Services may contain links to third-party websites, plug-ins, or applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements or practices. We encourage you to read the privacy policy of every website you visit.
Termination of Access
We reserve the right to terminate or suspend your access to any or all parts of our Services at any time, with or without notice, for any reason, including violation of these Terms or applicable law. You agree that we shall not be liable to you or to any third party for any such termination.
Survival of Terms
All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Arbitration Agreement
You and FireShield agree that any dispute, claim, or controversy arising out of or relating in any way to the Services, these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through final and binding arbitration rather than in court. The arbitration shall be conducted in Los Angeles County, California, in accordance with the rules of the American Arbitration Association (AAA) then in effect. Judgment on the arbitration award may be entered in any court having jurisdiction. You and FireShield agree to waive the right to a trial by jury and to participate in class actions or class-wide arbitration. Each party shall bear its own costs and fees associated with the arbitration, unless otherwise required by law or the arbitrator’s decision.
General Release and Waiver of California Civil Code Section 1542
In consideration for the opportunity to access and use the FireShield website, mobile application, and wildfire defense system (collectively, the "Services"), you expressly agree to release and discharge FireShield Wildfire Defense Systems LLC, its officers, employees, agents, affiliates, successors, and assigns from any and all claims, liabilities, demands, obligations, damages, or causes of action, known or unknown, arising out of or related to your use of, or inability to use, the Services.
By agreeing to these Terms, you knowingly and voluntarily waive the provisions of Section 1542, as well as any other statute, law, or rule of similar effect, to the fullest extent permitted by law. You further acknowledge and agree that this release includes a waiver of any and all rights and benefits conferred by Section 1542 of the California Civil Code, which states:
"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
